1.இந்த
நாளுக்கு முந்தைய 12 மாதங்களில் ஏதேனும் ஒரு நாளில் ,மின்சாரத்தின் உதவிகொண்டு உற்பத்திப்
பணி நடைபெற்றிருக்கவேண்டும்.
2.குறைந்த
பட்சம் 10 அல்லது அதற்கு மேற்பட்ட தொழிலாளர்கள் பணியில் ஈடுபட்டிருக்கவேண்டும்.

சுரங்கங்கள்
சட்டத்தின் (Mines Act ) கீழ் வரும் சுரங்கங்கள்,
இந்திய ராணுவத்தின் நடமாடும் பிரிவு, இரயில்வேக்கு சொந்தமான பயணிக்கும் (Running
shed) கொட்டகை, உணவு விடுதி, சிற்றுண்டிச் சாலை மற்றும் சாப்பிடும் இடம் போன்றவை தொழிற்சாலை
என்ற வரையறைக்குள் வராது.

என்பது யார்?
ஒரு
தொழிற்சாலையின் விவகாரங்கள் அனைத்தும் இறுதியில் (Ultimate Control) யாருடைய கட்டுப்பாட்டுக்குள்
இருக்கிறதோ அவரே Occupier என்று அழைக்கப்படுகிறார்.

என்றால் என்ன?
சுற்றிலும்
சுவர்களால் சூழப்பட்ட (அடைக்கப்பட்ட) ஓர் இடத்திற்கு Precincts என்று பெயர்.

1.Occupier
என்பவர் ஓர் இடத்தை Occupy செய்வதற்கு அல்லது ஓர் இடத்தை தொழிற்சாலையாகப் பயன்படுத்தத்தொடங்குவதற்கு
15 நாட்களுக்கு முன்பாக இது குறித்த எழுத்துபூர்வமான அறிவிப்பு ஒன்றை தலைமை ஆய்வாளரிடம்
(Chief Inspector) அளிக்கவேண்டும்.
2.புதிதாக
ஒரு மேலாளரை (Manager) நியமித்தால் ,அவர் பொறுப்பு ஏற்றுக்கொண்ட 7 நாட்களுக்குள், இது
குறித்த எழுத்துபூர்வமான அறிவிப்பு ஒன்றை ஆய்வாளரிடம்
(Inspector) சமர்ப்பிக்க வேண்டும் .
3.தொழிலாளர்கள்
, தொழிலகத்தில் பணியில் இருக்கும்போது அவர்களின் உடல் நலம், பாதுகாப்பு மற்றும் நலம்
ஆகியவற்றை Occupier உறுதி செய்ய வேண்டும்.
6.தொழிலாளர் (Worker) என்பவர்
யார்?
Principal Employer க்குத்
தெரிந்தோ தெரியமலோ, நேரடியாகவோ அல்லது (ஒப்பந்தக்காரர் உள்ளிட்ட) வேறொரு ஏஜென்சி மூலமாகவோ
நியமிக்கப்பட்டவர்.
ஊதியத்துக்காகவோ அல்லது
ஊதியம் இல்லாமலோ நியமிக்கப்பட்டிருக்கலாம்.
உற்பத்திச் செயல்முறையிலோ
அல்லது வேறு பணியிலோ அல்லது உற்பத்திச் செயல்முறை தொடர்பான பணியிலோ அல்லது உற்பத்தி
செய்யப்படும் பொருளுக்குத் தொடர்புடைய பணியிலோ அவர் ஈடுபட்டிருக்கலாம்.

இடலாம்.
5.ஒரு
தொழிலகத்தில் 250 அல்லது அதற்கு மேற்பட்ட தொழிலாளர்கள் பணிபுரிகிறார்கள் என்றால், அங்கு
உணவகம்(Canteen) அல்லது உணவகங்களை நிறுவி பராமரிக்க
வேண்டும் என்று விதிகளை ஏற்படுத்தவும் மானில அரசுக்கு உரிமை உண்டு.
பணியில்
உள்ள தொழிலாளர்களின் உடல் நலம் மற்றும் பாதுகாப்பு குறித்த தகவல்களை Occupier இடமிருந்து கேட்டுப் பெறுவதற்கு
அனைத்து ஊழியர்களுக்கும் உரிமை உண்டு.

COMMENT ON THE FOLLOWING
1.Arvind is the owner of a
concern manufacturing cigars. 20 persons are employed in the concern. Of these
20 employees, one is a graduate for supervising the work and another apprentice
learning work. The remaining 18 are employed not on the time wage system, but
on the piece work system. Is the concern „A Factory‟ within the meaning of that
term under the Factories Act, 1948 ?
ANSWER:
As per Section 2 (m) factory
means any premises including the precincts thereof - i. Whereon 10 or more
workers are working or were working on any day of the preceding 12 months, and
in any part of which a manufacturing process is being carried on with the aid
of power, or is ordinarily so carried on, or ii. Whereon 20 or more workers are
working or were working on any day of the preceding 12 months, and in any part
of which a manufacturing process is being carried on without the aid of power,
or is ordinarily so carried on. For computing the number of workers, all the
workers in different groups in a day shall be taken into account. So, in the
given case, as per section 2(m) the concern is a factory within the meaning of
that term under the Factories Act, 1948.
2) ABC Ltd bought ghee from various sources.
Ghee so bought were sampled chemically, analysed and packed in tins for
transportation to various stock points to be sold in market. Does this amount
to manufacturing process under the Factories Act, 1948?
ANSWER :
As per section 2(k) of The
Factories Act, 1948, manufacturing process means any process for- (i) Making,
altering, repairing, ornamenting, finishing, packing, oiling, washing,
cleaning, breaking up, demolishing, or otherwise treating or adapting any
article or substance with a view to its use, sale, transport, delivery or
disposal, or (ii) Pumping oil, water, sewage or any other substance; or; (iii)
Generating, transforming or transmitting power; or (iv) Composing types for
printing, printing by letter press, lithography, photogravure or other similar
process or book binding; (v) Constructing, reconstructing, repairing,
refitting, finishing or breaking up ships or vessels; (Inserted by the
Factories (Amendment) Act, 1976, w.e.f. 26-10-1976.) (vi) Preserving or storing
any article in cold storage; The process of sampling, analyzing and packing of
ghee for sale in market is a manufacturing process as per the definition under
the Factories Act, 1948.
3.Manager of the factory fixed
the working hours of women from 6:00 P.M. to 1:00 A.M. during the period from
Monday to Friday of first week of May 2014. Whether it is permissible, cite
with Rule position.
4.Daily working hours in a
factory cannot be more than 8 hours on any day considering ceiling of 48

ANSWER:
As per Sec . 51 of the Factories
Act, 1948 no adult employee is required to work more than 48 hours in any week.
Subject to this rule, no adult employee shall be required to work for more than
9 hours in any day. But in order to facilitate the change of shift, this limit
may exceeded. This can, however, be done with the previous approval of the
Chief Inspector of Factories.
